- Yes, they don't need to be sworn it. At noon, they automatically become VP and President. So no, Biden was not Bush's VP for a few minutes.
- NO.......for five or so minutes he was the President. He was sworn in before Obama and therefore stood as Commander in Chief until Obama took the oath.

- Obama and Biden gained their positions in office at exactly 12 Noon regardless, however the power to "faithfully execute" the office is only given until after the oath has been sworn. Basically it means Obama had the office of president, but not its powers. So for 6 minutes Biden was only the acting president of the united states seeing as Obama is already holding the office but not the power, and when a president is unable to execute the abilities of his office, the vice president is the acting president.
- Biden was acting president for a few minutes. Similar to when Bush had his colon screenings he transfered power to Cheney (it happened twice 2002 + 2007). This also happened when Reagan had surgery in 1985 (H. W. Bush was acting president). The key word is "acting" president because Biden would have to take the Presidential oath to become the 44th President (VP + P's oaths are different). At 12:00pm Bush's term had expired Obama was President but could not perform the duties of President because he was not sworn in. Biden was sworn in but under the 25th amendment in order for him to act on anything he has to have the written approval on all cabinet members (who have not been confirmed) or the senate. Biden was only acting President due to the Presidential line of succession. One could interpret the 25 Amendment in a way that Biden has no power in those 5 min until he received the proper documentation. The Speaker of the House Nancy Pelosi might have had claim to power. I could see a lawyer easily making that argument. In the end it doesn't really matter. Nothing happened and if something did happen I am sure the speaker would not challenge the V P's authority. If she did the Supreme Court would have to step in very quickly.
